Title Insurance

You have more than likely heard about title insurance if you have purchased or sold a home. Part of your closing costs will include title insurance. Title insurance is a one-time payment due at the time of closing. The seller is customarily responsible for the purchase of a title insurance policy for the buyer.

Your mortgage lender will order a title search from a title company before your home closes. That title company will search public records that are associated with your home. They will search for title defects that could affect the lender or the buyer’s property rights.

Attorneys acting as title insurance agents will review information about the current owner(s) and buyer(s), along with the details of the property’s history. Attorneys and the title insurance companies on whose behalf they work, ensure that the title provided to the buyer at closing is free from errors, liens, judgments or easement issues. This is known as “clearing title” or producing a “clean title”.  After the transaction concludes, the title company will issue a Title Insurance Policy to the buyer(s) along with the recorded deed.
